In Georgia, the Court takes many factors into consideration when awarding custody to parents.  Ultimately, the best interests of each child involved is the overriding factor in all cases.  Parenting arrangements typically involve matters such as:

• Legal Custody: when a parent is awarded legal custody, he or she is given the legal right to make important decisions for the child, including medical care, education, religious training, extra-curricular activities, etc.  Legal custody can be awarded to one parent (sole legal custody) or both parents (joint legal custody).  Courts prefer joint legal custody.  One parent will have the final say in joint legal custody arrangements.
• Physical Custody:  Physical custody pertains to which parent the child will reside with the majority of the time.  In many cases, the parent with whom the child lives with more often is typically awarded child support.  Like legal custody, physical custody can be awarded solely or jointly.  The parent who is not awarded primary physical custody has a general right to visitation with his or her child.  Parenting time with a child will be included in any Court Order.
• Visitation: A child will typically thrive in an arrangement where the child has regular contact and involvement with both parents.  We work hard to take in account your unique situation to preserve your relationship with your child.
